Suzuki - Suzuki Entry
THIS IS NOT A SWEEPSTAKES OR A GAME OF CHANCE. THIS IS A
CONTEST IN WHICH THE WINNER WILL BE CHOSEN BASED ON THE
CHARACTER, QUALITY, AND ORIGINALITY OF THE CONTEST ENTRIES.
1. Definitions.
(a) "You" or "your" means any person who enters, participates in, or wins the "Wanted:
KingQuad Alive and Running" contest.
(b) "Contest" means the "Wanted: KingQuad Alive and Running" contest referred to and
described in these rules.
(c) "Rules" means this document, entitled Rules for "Wanted: KingQuad Alive and
Running" Contest
, and all the terms contained in this document. You may obtain
a copy of these rules by sending a self-addressed, stamped envelope to the address
shown in number "2" below.
(d) "Application package" means one set of the materials, described below, which you
may submit to participate in the contest.
(e) "American Suzuki" means American Suzuki Motor Corporation and/or, as applica-
ble, Suzuki Motor Corporation.
(f) "KingQuad" and "Suzuki KingQuad" mean any 1991-2002 Suzuki LT-F4WDX
or LT-F300F.
(g) "Prize" shall mean the Suzuki KingQuad that is offered to the winner of the contest.
2. How to Participate. To be eligible to participate and win, you or an immediate fam-
ily member (parent, child, spouse, or sibling) must own a KingQuad. Simply
submit a complete application package to American Suzuki Motor Corporation, Attn:
"KingQuad Contest", P.O. Box 1100, Brea, CA 92822-1100. No more than one entry per
person, and no more than one entry per KingQuad, will be accepted.
No mechanically reproduced entries accepted.
3. Application Package. Your application package may contain up to two (2) photos,
and up to 100 words of text. Illegible submissions will not be considered. Your
application package should show how you use your KingQuad. We're looking for a
KingQuad that is still in use after years of service, not necessarily the prettiest one or
the one with the fewest miles. You must provide a valid and working telephone
number in your application package.
4. Winner Selection and Announcement.
(a) Odds of Winning: The odds of winning are based on the number and quality of
entries received.
(b) Criteria for selection of winner: the winner will be chosen based on a variety
of criteria, including but not limited to: (i) the age, mileage, condition, and working
order of the entrant's KingQuad; (ii) the variety, quality, and utility of activities for
which the entrant's KingQuad is used; (iii) the appearance of the entrant's KingQuad;
and (iv) any other matter that American Suzuki deems relevant and appropriate.
(c) Method of selection of winner: following receipt of all application packages,
American Suzuki will select semi-finalists in a quantity to be determined by American
Suzuki based on the above. American Suzuki will then consider the application pack-
ages of the semi-finalists, and may contact the semi-finalists for further information.
Upon consideration, a winner will be selected and then notified.
5. Prize. One 2005 model Suzuki KingQuad, the model and features of which shall be
determined by American Suzuki. If you win, you will be required to take delivery at a
location of American Suzuki's choosing. You will not be allowed to exchange your prize
for cash. The winner will also be asked to participate in a media event and ATV ride in
Canada. American Suzuki will cover all travel expenses for this event. The approximate
retail value of the prize is $7,199 not including any applicable tax, license, transporta-
tion, dealer fees, or other expenses.
6. Right to Terminate. American Suzuki reserves the right, in its sole and absolute
discretion, to terminate the contest at any time, for any reason or no reason, or to sub-
stitute prizes. In the event of termination, no entries will be returned. If termination
occurs before the prize has been delivered and accepted, American Suzuki may decide,
in its sole and absolute discretion, not to award any prize to any contestant.
7. Other Terms and Conditions.
(a) Eligibility: to be eligible to participate and win, you must be at least 18 years
of age and a lawful resident of the United States. Residents of Hawaii ineligible. The
contest is not open to employees of American Suzuki or its agents, affiliates, or relat-
ed individuals or entities, or any person related to employees, officers, shareholders,
or agents of the same. Proof of eligibility may be required at any time. American
Suzuki will not award the prize to any person who was not eligible to participate as of
the date of announcement of the contest. In the event of any dispute, American Suzuki
shall have the right to determine, in its sole and absolute discretion, whether you were
eligible to participate as of the date the contest was announced. This contest is not
offered where prohibited by law.
(b) Deadline to Enter: July 5. All entries must be postmarked on or by July 5, and must
be received by American Suzuki on or before July 12. No late entries will be considered
for any reason or under any circumstances, regardless of cause; not responsible for lost,
stolen, or otherwise undeliverable entries. Any entry delivered to American Suzuki
with postage due will be disqualified.
(c) No contract: neither this document, nor the terms contained herein, nor any conduct
of you or American Suzuki, nor any advertisement, solicitation, or promotional or other
material shall be deemed as creating a contract or contractual or quasi-contractual rela-
tionship between you and American Suzuki or any other individual or entity.
(d) Taxes, fees, and expenses: certain expenses are associated with the giving of any
prize, including taxes, delivery charges, and various other fees, costs, and expenses.
If you win, you must agree to pay all such fees, costs, and expenses incurred by
American Suzuki. Because the amounts of such fees, costs, and expenses are difficult
to calculate precisely in advance, American Suzuki may elect, in its sole discretion, to
require you to pay a flat rate based on an estimated amount of all fees, costs, and
expenses American Suzuki will be required to pay. In such a case, the amount you will
be required to pay will not exceed ten percent (10%) of the retail value of the prize.
Payment of federal income tax will be your responsibility. Any other expenses associ-
ated with the contest will be your responsibility.
(e) Notification of winner: upon selection, the winner will be notified by American
Suzuki via any method reasonably calculated to provide actual notice, which method(s)
shall be chosen in the sole and absolute discretion of American Suzuki.
In the event that notification cannot for any reason be made (as determined by
American Suzuki in its sole and absolute discretion), American Suzuki will select an
alternate winner, and the original winner will be deemed to have forfeited the prize.
Any winner who does not respond within 14 days of notification will be deemed to
have forfeited.
(f) Sponsor: the sponsor of the contest is American Suzuki Motor Corporation,
3251 E. Imperial Hwy., Brea, CA 92821-6795; (714) 996-7040.
8. Agreements by Entrants.
(a) Agreement to be bound: by entering the contest, you agree to be bound by these
rules, and by any and all other rules or restrictions that American Suzuki may place
upon the operation and execution of the contest, or any matter related thereto.
(b) Publicity: if you are the winner, you will be required to execute an agreement grant-
ing American Suzuki the right to use, without any additional compensation, images of
you or your KingQuad, along with any other words or materials you have submitted in
connection with the contest, in future promotional materials or releases. In addition,
American Suzuki may request (but not require) that you participate in promotional
events such as vehicle releases, photo or video opportunities, and/or press confer-
ences. If you are asked to participate, and you agree to participate, in such promotion-
al events, American Suzuki will pay for your travel, lodging, and meals; however, you
will not receive any additional compensation.
(c) Intellectual property: once submitted, your entry will become the property of
American Suzuki, and you will cease to hold any rights in any of the contents of your
application package. American Suzuki will not return any application materials. By sub-
mitting your application package, you agree that (1) American Suzuki may use any and all
such materials at any time and in any manner it chooses; (2) American Suzuki shall not
be required to pay you any compensation for such use; (3) you will execute, if American
Suzuki so requests, an agreement transferring the rights in any and all such material to
American Suzuki for no charge; and (4) American Suzuki may use, without payment to
you of any kind, your name and likeness or reproductions of your KingQuad in materials
that American Suzuki may prepare or distribute in the future.
(d) Waiver and Release: by participating in the contest, you agree to hold American
Suzuki and its affiliates and related entities, officers, directors, employees, successors,
predecessors, agents, and assigns harmless from and against any and all actions, suits,
causes of action, claims, demands, liabilities, loss, damage, expense, or compensation
of whatever kind or nature, including attorney's fees and costs, which such individuals
or entities may at any time incur or sustain or suffer arising out of or in any way relat-
ed to the contest or American Suzuki's administration of the same, and you agree to
release any and all claims against the same individuals and entities to the same extent.
If you are selected as winner, you will be required to execute a comprehensive release
of liability for any injuries and damages and a conveyance of any and all rights in the
application materials.
