GRAND PRIZE: [One (1) Grand Prize will be awarded]: The Grand Prize consists solely of a three (3) day/two (2) night trip (specific dates of travel are to be determined
solely by Sponsors) for Grand Prize Winner and one (1) Travel Companion to New York City, NY ("NYC"), including round-trip ("R/T") coach air transportation (on a carrier
selected by Sponsor) between the major U.S. gateway city airport closest to the Grand Prize Winner's residence and a NYC area airport, two (2) nights hotel
accommodations (single standard room, double occupancy) at a hotel selected by Sponsors, R/T airport/hotel transfers in NYC, a Lucky Magazine photo shoot with a
professional photographer (length and format of photo shoot and specific photographer used will be selected by Sponsors), plus a $500 American Eagle Outfitters gift card.
The approximate retail value of the Grand Prize is $4,000, although actual value is dependent on specific dates of travel and point of departure.
Travel arrangements must be made through Sponsors' agent. Grand Prize Winner and his or her travel companion must travel together on the same itinerary. All meals,
gratuities, additional ground transfers, incidentals and any other expenses not specified herein as being awarded are the sole responsibility of the Grand Prize Winner and
his/her travel companion. If the Grand Prize Winner's residence is within 75 miles of the greater New York City, NY metropolitan area, airfare will not be included in the prize
package and no additional prize element will be substituted in full satisfaction of Sponsors' obligations hereunder. Grand Prize Winner and his or her travel companion will be
required to provide government issued photo identification at time of travel. No changes will be made to travel details once any portion of travel arrangements has been
made. Sponsors are not responsible for changes in schedule of any element of the Grand Prize. Certain travel restrictions may apply.
If the Grand Prize Winner is unable to travel during the dates determined by the Sponsors, they will forfeit their prize in its entirety and an alternate winner will be selected. If
alternate winner selection is necessary for any reason, the entrant judged to achieve the next highest score in the opinion of the judges shall be declared the winner.
Sponsors have complete control of the photo shoot, including, but not limited to, apparel, makeup, hair, etc. The decision as to which photograph (if any) will appear on the
American Eagle Outfitters/Lucky Magazine cover flap lies solely with the Sponsors. Winner waives all rights to any photographs taken as well as his/her right to approve
which photograph is used. Winner will receive only those items listed in the prize description. No additional compensation for photo shoot/use of photographs will be
provided to winner and/or winner's agent(s). Prize is not transferable or redeemable for cash. No substitution, transfer or cash equivalent of a prize by the winner is
permitted. All applicable federal, state, local or other taxes are the sole responsibility of winner.
GENERAL: This Contest is subject to all Federal, state and local laws and regulations. All entrants represent and warrant that any photographic material that he or she
submits is original with him or her, has not been previously published or won an award, does not infringe upon the copyright or any other right or interest of any other person
or organization, and that the entrant has not previously granted any rights to such material to any other person or organization, nor does any third party have any interest in
such materials. All entrants represent and warrant that they are not under any contract, sponsorship, endorsement or other similar obligation which precludes their
participation in this Contest or which precludes the use by Sponsors of the photographs from the photo shoot. Sponsors reserve the right to alter, edit and/or recreate the
Contest winner's entry and/or the photos taken during the photo shoot portion of the prize in any way Sponsors desire. Sponsors and their respective designees may, but are
not obligated to, use the original submission by the winner, any and all of the photos taken of the winner during the photo shoot portion of the prize, or the final version(s) as
revised by Sponsors or their respective designees, or a combination or parts of either or both, in any media now or hereafter known throughout the world without any further
permission required from entrant or any third parties.
ENTRANTS AGREE THAT RELEASEES SHALL NOT BE LIABLE FOR PERSONAL INJURIES, DEATH, DAMAGES, EXPENSES OR COSTS OR LOSSES OF ANY KIND
RESULTING FROM PARTICIPATION OR INABILITY TO PARTICIPATE IN THIS CONTEST OR ACCEPTANCE OF OR USE OR INABILITY TO USE THE GRAND PRIZE
OR PARTS THEREOF INCLUDING, WITHOUT LIMITATION, CLAIMS, SUITS, INJURIES, LOSSES AND DAMAGES RELATED TO PERSONAL INJURIES, DEATH,
DAMAGE TO OR DESTRUCTION OF PROPERTY, RIGHTS OF PUBLICITY OR PRIVACY, DEFAMATION OR PORTRAYAL IN A FALSE LIGHT (WHETHER
INTENTIONAL OR UNINTENTIONAL), WHETHER UNDER A THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), WARRANTY OR OTHER THEORY. GRAND
PRIZE WINNER AND THE GRAND PRIZE WINNER'S TRAVEL COMPANION RELEASES THE RELEASEES FROM ANY AND ALL LIABILITY AND RESPONSIBILITY
WITH RESPECT TO THE GRAND PRIZE (INCLUDING ANY PROPERTY LOSS, DAMAGE, PERSONAL INJURY OR DEATH). GRAND PRIZE WINNER AND HIS OR HER
TRAVEL COMPANION ACKNOWLEDGES THAT THE AFOREMENTIONED INDIVIDUALS AND ENTITIES HAVE NEITHER MADE NOR ARE IN ANY MANNER
RESPONSIBLE FOR ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESSED OR IMPLIED, IN FACT OR IN LAW, RELATED TO THE PRIZE OR PARTS
THEREOF.
If the Grand Prize or a portion of the Grand Prize cannot be awarded due to circumstances beyond the control of the Sponsors, a substitute prize of equal or greater retail
value will be awarded at the discretion of the Sponsors. Releasees shall not be liable to Grand Prize Winner or any other person for failure to supply the Grand Prize or any
part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s),
regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane,
embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection,
riot, or any other cause beyond Releasees' sole control. Releasees shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions
whatsoever by the air carrier(s), hotel(s), or other transportation companies or any other persons providing any of these services and accommodations to passengers
including any results thereof such as changes in services or accommodations necessitated by same. Releasees shall not be liable for any loss or damage to baggage.
If for any reason this Contest is not capable of running as planned or does not allow the proper playing of the Contest and processing of entries per these rules, or if
tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in Sponsors' sole opinion, corrupt or affect the administration,
security, fairness, integrity, or proper conduct of this Contest, Sponsors reserve the right, at their sole discretion, to disqualify any individual implicated in such action, and/or
to terminate further entry in this Contest. In the event that termination of further entry in this Contest is made necessary as detailed above, all eligible entries received as of
the termination date will be judged according to the judging criteria detailed above. If termination of this Contest occurs, notification will be posted on the web site at
www.ae.com. No notification of termination shall be sent to entrants. Any attempt by an entrant or any other individual to deliberately undermine the legitimate operation of
the Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsors reserve the right to seek damages and other remedies from any such
person to the fullest extent permitted by law.
